Mental Health Alliance comment on Regina v Ashworth Hospital (now Mersey Care National Health Service Trust) (Appellants) ex parte Munjaz (FC) (Respondent)
Mental Health Alliance Chairman Paul Farmer said today:
"The Munjaz ruling is hugely disappointing. Mental Health Alliance members believe the Mental Health Act's Code of Practice should not be seen as optional. This case shows how important it is for the next Mental Health Act to have clear guiding principles, to be drafted with precision and to have a Code of Practice that is legally enforceable in all but the most extreme cases. Without these provisions, the Government's new Bill will cause confusion for staff, anxiety for service users and their families and end up the subject of endless judicial review."
